In 2012, the Supreme Court held that it is unconstitutional for a court to sentence a juvenile to life without the possibility of parole (Miller v. Alabama). In 2016, the Supreme Court determined that the Miller decision should be applied retroactively (Montgomery v. Louisiana). The general rule is that a court’s decision that changes practice, or a new law that changes a penalty, are not applied to cases that have gone before. To do so every time the law changes would be a logistical nightmare. In this instance, the reviewed scientific and psychological evidence demonstrates that juveniles have diminished capacity due to their age and are more susceptible to peer pressure, and because of their youth, are more likely to change in the future.
