JADM220 (Introduction to Ethics and Criminal Justice)

Week 1 discussion

DQ1 MORALS VS. ETHICS

Compare and contrast morals and ethics. What are their differences? Their similarities? Give examples of each.

DQ2 SENTENCING AND PERMISSIBILITY

Several states now allow judges to order men who solicit prostitutes to buy ads in local newspapers to run their photos and the charges against them as a form of humiliation and shame. Some states even permit the names of these men to be placed on websites or put on billboards. Is such a sentence for soliciting a prostitute morally permissible? Why or why not?

JADM220 (Introduction to Ethics and Criminal Justice)

Week 2 discussion

DQ1 ETHICAL PRINCIPLES

In a survey, respondents were asked what course of action they would take if an automatic teller machine (ATM) gave them $200 too much during a transaction. 50% of those responding said that they would keep the money. If you received such an overpayment, what would you decide? Upon what moral principles would you rest your decision?

DQ2 HIERARCHY OF GOODS

The famous French artist Paul Gauguin left his wife, his child, and his job as a banker in order to pursue his art career. He moved to the South Pacific, and eventually, he became one of the most famous artists in the world. From the standpoint of the hierarchy of ethics, did Gauguin do what was morally permissible? Why or why not?

JADM220 (Introduction to Ethics and Criminal Justice)

Week 3 discussion

DQ1 FORMALISM IN THE WORKPLACE?

Several employees of the federal government were investigated for misconduct in the performance of their duties. Initially, the five denied the charges. When it was discovered that the five employees did, in fact, engage in the alleged misconduct, they were given additional punishment because they lied to the investigators. The U.S. Supreme Court upheld the additional punishment, holding that an employee has no right to make false statements.

According to the Court, when asked about wrongdoing, an employee has legal choices: tell the truth, or don’t say anything at all (LaChance v. Erickson, 118 S.Ct. 753 [1998]). On what ethical principle was the Court’s decision based? Do you agree with it? Why or why not?

DQ2 THE RING OF GYGES

Read Critical Thinking Exercise 4.3, “The Ring of Gyges,” in Chapter 4 of the text. What would Aristotle, Kant, and Mill each do if they had such a ring as the Ring of Gyges? Explain your reasoning.

JADM220 (Introduction to Ethics and Criminal Justice)

Week 4 discussion

DQ1 THE LAW AND MORALITY

Do laws mandating the use of motorcycle helmets infringe on the rights of adults to make their own personal safety decisions? Can’t adults decide by themselves on whether or not they want to wear helmets? Why or why not?

DQ2 PRIVACY RIGHTS

Several states and cities have adopted laws and policies designed to prevent minors from owning cell phones without written adult permission. Proponents claim that these devices are used by drug dealers, they distract students, and they disrupt classes. On the other hand, opponents claim that such prohibitions are an unreasonable and unnecessary intrusion on privacy. Evaluate this law from the three different ethical perspectives. Upon which principle or principles would you base your vote on the issue? Why?

JADM220 (Introduction to Ethics and Criminal Justice)

Week 5 discussion

DQ1 ETHICAL CHALLENGES FACED BY POLICE

Why are laws alone insufficient to guide police actions in the area of searches and seizures?

DQ2 POLICE AUTHORITY VS. CITIZEN RIGHTS

How might balancing police authority with the rights of citizens become more difficult as society continues to change?

JADM220 (Introduction to Ethics and Criminal Justice)

Week 6 discussion

DQ1 ETHICS OF COURTS

Do you believe that a judge’s sentencing decisions should be focused on the past, present, or the future? Explain your answer, and provide some examples.

DQ2 SENTENCING AND ETHICS

It has been argued that alternative punishments are needed that are properly painful, proportional to the offense, humane, and less expensive than incarceration. Such punishments would be used to sentence those offenders who fall between minor criminals and criminals who are violent. According to proponents, corporal punishment that applies a non-lasting intense pain, such as electric shock, can do the job. Unlike prison, the punishment can be over within seconds, and it would not have the severe long-term effects of prison. Electric shock punishes the offender, and only the offender, for the offense. Conversely, prison punishes innocent people, such as the offender’s family, by depriving them of support.

Applying ethical principles, what is the moral permissibility of punishment by electric shock?

JADM220 (Introduction to Ethics and Criminal Justice)

Week 7 discussion

DQ1 ETHICAL PRINCIPLES AND PROPER CONDUCT

Read the Ethics Checkup scenario on page 125 of Chapter 9 in the text. Using ethical principles, justify employer monitoring of employee e-mail and Internet use. Explain your conclusions, and provide examples to support those conclusions.

DQ2 ETHICAL DECISIONS AND CONDUCT

Read Critical Thinking Exercises 10.1 and 10.2 on pages 142-143 in the text, and respond to the thoughts and questions posed by the exercises. If differences of opinion arise, then debate the issues and try to come up with a consensus.
